Brace yourselves—you’re in for a shock. Yes, the draft bill proposed by the Ministry of Family, Labour and Social Policy—intended to implement the EU Platform Work Directive—introduces sanctions for failing to meet the obligations arising from it.
The National Labour Inspectorate can impose a fine on either the Platform or the Fleet Partner. However, in reality, a situation could arise where:
– the Platform claims the Partner is responsible for the violation,
– the Partner claims the Platform is actually responsible.
Consequently, proceedings drag on, and the fine goes unpaid. Furthermore, the Platform can, of course, appeal to the courts, effectively delaying the process for years.
And here’s the best part: under the draft bill, the fine ranges from 2,000 to 60,000 PLN. For a Platform with annual revenues in the tens of billions of euros, such a fine is essentially just a cost of doing business rather than a real deterrent. It’s like someone earning 5,000 PLN getting a fine of 1 grosz.
