The Dutch Ministry of Social Affairs and Employment has published a draft regulation to implement the EU Directive on Platform Work. The draft introduces a mechanism for presuming the existence of an employment contract. For this to be triggered, at least two of five criteria must be met:
1. The platform determines or directly influences the level of remuneration.
2. The platform decides on or influences the allocation of duties and tasks.
3. The platform monitors and evaluates the quality and results of work performed.
4. The platform restricts the freedom to accept or reject assignments, for example, by imposing penalties or sanctions.
5. The platform forces employees to adhere to specific rules regarding appearance, dress code, behavior towards clients, and the manner of completing tasks.
The draft is currently at the draft proposal stage and has not yet been submitted to the Dutch Parliament.
