In June, we described (here) the status of work on the implementation of the Platform Work Directive in the Netherlands.
In July, the Dutch government published an official draft of the Platform Work Act. The new law provides for a legal presumption of employment “when there are actual grounds for order and supervision.” More detailed details and solutions are to be specified in a regulation issued by the relevant ministry. This solution will allow for bypassing parliament in the future and changing the rules at virtually any time.
Interestingly, the new law will also apply to Fleet Partners when the person performing work for Platforms has a contract with them.
