In Austria, the Ministry of Labour and Social Affairs is responsible for implementing the Platform Work Directive, which is in talks with social partners, trade unions, and the Chamber of Labour.
The Ministry has prepared a proposal for a general presumption of tenure, which will be based on facts indicating “direction and control” by the Platform – importantly, the proposal does not introduce rigid criteria necessary to trigger the procedure.

However, it is unclear whether the presumption will have to be triggered individually by each person working for the Platforms (case by case) or whether it will be possible to act collectively. There are also concerns that employees will be forced to go to court each time to exercise this right. The regulations have not yet been submitted to the Austrian Parliament, so their final form may change.
