As a reminder, all European Union countries must implement the EU Platform Work Directive into their legal systems by December 2, 2026. This Directive is a set of rules defining the principles of employment and supervision of work by platforms (including delivery platforms). The rules contained in the Directive are rather loose, and their practical implementation can vary significantly, depending on the political stance in a given country.
And now for Slovakia: The Ministry of Labor has published draft regulations introducing a presumption of work across the platform economy.
The proposal stipulates that if a platform employee presents evidence suggesting that the work is performed under subordinate conditions and managed by the platform (or an intermediary), the relationship will automatically be deemed to be full-time employment. However, the burden of proof is reversed: platforms will have to prove in court that the work was not subordinate in nature (of course, only if they do not agree to employ the employee under an employment contract).
The project will now be subject to “public consultation” and then submitted to the Slovak Parliament.
