The Italian government has published a decree establishing rules for the simultaneous implementation of several EU Directives on online platform work (including the Minimum Wage and Platform Work Directives). It establishes a general legal presumption of the existence of an employment relationship based on “indications of external control or management,” including “through algorithmic management.” Platform workers have the right to have their algorithm’s decisions reviewed by a human and penalties for sharing platform accounts have been introduced. Platforms must also retain all employee records for a minimum of five years.
