A new law affecting delivery workers for platforms has been in effect in New York for three days [January 26, 2026]. Here are three key changes:
– Expanded minimum wage protections: Delivery platforms must now pay workers at least $21.44 per hour (excluding tips), with a guaranteed increase annually.
– Transparency and timeliness of pay: Platforms must pay workers no later than seven calendar days after the end of the pay period and provide a detailed written statement.
– Tip integrity: Platforms must offer customers a clear tip option before or at the time of checkout, including a suggested tip of at least 10% of the purchase price.
At the same time, further work is underway on the implementation of Act Intro 1332-2025 (which, among other things, increases protection against arbitrary suspension of accounts of individuals working as Suppliers), which we wrote about here.
