This is news from the world of big money. In June, we reported (here) that the JustEat platform in Spain (operating as Pyszne.pl in Poland) had sued the Glovo platform. Just Eat accused Glovo of unfair competition by avoiding the employment of people working as delivery drivers under employee contracts (Just Eat itself employs them under contracts of mandate). Just Eat claimed €295 million from Glovo.
In July, the court dismissed the lawsuit. It found that the contracts Glovo had been using since 2019 guaranteed “autonomy to delivery drivers” and that they complied with the Supplier Act.
However, in early September, an appeal against this ruling was filed with the Barcelona court. JustEat estimates that Glovo has saved over €645 million in recent years by employing ostensibly self-employed workers, which “allowed Glovo to gain a significant competitive advantage.”
For our part, we would like to remind you that Glovo has already been fined several times by courts in Spain for these contracts, and only the protective umbrella of the Commercial Court saved the platform from bankruptcy.
