Instacart, a grocery delivery platform operating in the US and Canada, filed a lawsuit against the city in the District Court of New York a few days ago, citing the minimum wage regulations for Platform Delivery workers. Specifically, the lawsuit concerns the new minimum hourly wage, which, effective January 1, 2026, will be $21.44 per hour. The new law also introduces simplified rules for paying tips to Delivery Workers and changes the recordkeeping requirements for Platforms.

Instacart, a company with nearly $4 billion in revenue in 2024, justifies its lawsuit by arguing that paying such a wage is detrimental to the company and will be practically impossible.
