Recent internal negotiations between European Union bodies regarding the Online Platform Work Directive have not led to an agreement. As a result, the Belgian Presidency is currently working on a new, simplified text of the Directive, trying to find an acceptable compromise. The new text is reportedly intended only to outline “common principles” on the presumption of employment, rather than a specific proposal, leaving it to individual EU countries to develop their own detailed criteria. The common principles will cover four areas: that better working conditions must be ensured, that this must be reflected in national law, that the final decision on determining employment status will be based on national definitions, and that there must be a way for Platforms to rebut the presumption of employment.
