Last Wednesday [24/04/2024] the European Parliament adopted the Platform Work Directive. So it’s time to summarize what we know about her:

  • The full name is the Directive on the improvement of working conditions for platforms
  • The entire text is available here: PDF
  • The directive applies to all types of Platforms. Both those with deliveries and transport, nursing services, cleaning, etc. And there are over 500 of them in Europe!
  • The directive creates the concept of “presumption of employment”. This will be a legal instrument thanks to which people working for Platforms will be automatically recognized as employees after meeting appropriate criteria. These conditions are to be determined by each Member State itself.
  • The directive also includes a set of new workers’ rights in relation to the management of workers by algorithm. We have the right to information about whether and what data is collected about us.
  • The directive also introduces the obligation for a human (not an algorithm) to supervise key decisions regarding our work. But again: what is a “key decision” and what is not will be determined by each country on its own.
  • States have 2 years to implement the Directive.

So now the time for hard work begins: we have two years ahead of us, first of all, monitoring the ideas of officials from the Ministry of Family, Labor and Social Policy (because it will most likely be responsible for implementing the Directive). Then what the MPs will do about it.

And as all signs in the sky indicate, the Platforms have already prepared a team of lobbyists and lawyers, of course supported by appropriate funds. So we have a really big task ahead of us.
