Interestingly, they are supposed to come into effect retroactively (i.e. from June 1, 2021). Unfortunately, we have not yet been able to see this document, so we can neither confirm nor deny it.<\/p>\n<p>But one thing is certain: when working for Platforms, the terms of cooperation are not negotiated. You either accept them or you don&#8217;t work. It&#8217;s as simple as building a flail. So introducing terms in this manner is an obvious coercion.<\/p>\n<p>\u0141ukasz, who runs the website <a href=\"https:\/\/dostawca-jedzenia.pl\/uber-warunki\/\" target=\"_blank\" rel=\"noopener\">www.dostawca-jedzenia.pl<\/a> (we recommend it!), published an article on this topic on Saturday [24.08.2024]. He suggests that, by introducing new terms, Uber Eats is protecting itself against the consequences of the Directive on Work for Platforms adopted by the European Union (you can read more about the Directive <a href=\"https:\/\/zentrale.pl\/category\/dyrektywa-o-pracy-dla-platform\/\">here<\/a>). He also claims that the Directive in its current form is unfavourable for people working as Suppliers. And here, unfortunately, we cannot agree with him. Indeed, the Directive could have been more specific and restrictive &#8211; in the original versions, it was supposed to be that way. But it is not. It is very, very general. And as we have already pointed out many times: it is completely unknown how it will be implemented in Poland. Albo je akceptujesz, albo nie pracujesz. Proste jak budowa cepa. Sugeruje on, \u017ce, Uber Eats, wprowadzaj\u0105c nowe warunki, zabezpiecza si\u0119 przed konsekwencjami uchwalonej przez Uni\u0119 Europejsk\u0105 Dyrektywy o Pracy dla Platform (wi\u0119cej na temat Dyrektywy przeczytasz <a href=\"https:\/\/zentrale.pl\/category\/dyrektywa-o-pracy-dla-platform\/\">tutaj<\/a>). Twierdzi te\u017c, \u017ce Dyrektywa w obecnym kszta\u0142cie jest niekorzysta dla os\u00f3b pracuj\u0105cych jako Dostawcy. I tu niestety nie mo\u017cemy si\u0119 z nim zgodzi\u0107. Faktycznie, Dyrektywa mog\u0142a by\u0107 bardziej konkretna i restrykcyjna - w pierwotnych wersjach taka w\u0142a\u015bnie mia\u0142a by\u0107. Ale taka nie jest. Jest bardzo, bardzo og\u00f3lnikowa. I tak jak ju\u017c zwracali\u015bmy uwag\u0119 wielokrotnie: kompletnie nie wiadomo, jak b\u0119dzi\u0119 wygl\u0105da\u0142o jej wdro\u017cenie w Polsce.
