For weeks, forums have been flooded with questions about “mandatory service contracts.” People working as providers are asking: what’s going on? Why do I have to upload the contract to the app? Does this mean the end of lease agreements? What if I run a business? Does this apply to all platforms? What if this…? What if that…?
\nThere are as many answers as questions, the vast majority of which are quite confusing.<\/p>\n

We’ll explain in three points:<\/p>\n

1. Legally, nothing has changed; everything remains as it was.
\n2. No, this does not concern the implementation of the Platform Work Directive in Poland. No one in Poland knows how or when it will be implemented (information confirmed by the Ministry of Labour).
\n3. The current actions of platforms are the result of the implementation of the DAC7 Directive two years ago.<\/p>\n

The DAC7 Directive is an EU law whose main goal is to tighten tax regulations online. The law requires online platforms (both sales platforms like Allegro and Vinted, and service providers like Glovo and UberEats) to automatically report to the Tax Office how much their users (both individuals and businesses) earn. In Poland, these regulations came into effect in mid-2024.<\/p>\n

Before the introduction of DAC7, authorities had no idea who was earning how much online, unless they conducted a targeted audit. Now, platforms are handing this data over to them. Now, if you complete even one delivery and earn only 15 PLN, your data will still be reported to the Tax Office.<\/p>\n

Once a year, the Platforms report to the Tax Office:
\n– name, surname, PESEL number, and address
\n– Fleet Partner details
\n– exact salary paid and bank account numbers
\n– commissions or contributions collected by the Platform<\/p>\n

Before DAC7 came into effect, Fleet Partners could conceal our real income under “lease agreements,” and it was difficult for the Tax Office to verify this on a mass scale. When DAC7 came into effect, the Platforms realized that in January they would be sending reports to the Tax Office showing hundreds of millions of z\u0142oty paid out under fictitious lease agreements.<\/p>\n

So, this whole mess isn’t about improving our social conditions (through properly paid contributions, such as health or accident insurance). The Platforms simply want to avoid multi-million fines.<\/p>\n
