The Czech Ministry of Labour and Social Affairs has developed and published a draft law aimed at implementing the EU Directive on Platform Work. The proposal, which includes, among other things, a change in the definition of an employment relationship, is currently in the public consultation phase.<\/p>\n
The Czech-Moravian Trade Union Confederation (\u010cMKOS) has already responded to the proposal, criticizing it. The unions argue that modifying the definition of an employment relationship is not necessary for the proper implementation of the EU directive. They also warn that the new regulations carry the risk that only office workers, not manual workers, would be considered employees under the law.<\/p>\n
The proposal is also criticized for its mechanism of triggering a legal presumption of the existence of an employment relationship. According to the current draft, individuals working for platforms would only be able to pursue their rights in court.<\/p>\n
