The Luxembourg government has published a draft law on the implementation of the Platform Work Directive. The draft, which still needs to be passed by Parliament, introduces a legal presumption of employment, which can be triggered if three of 13 criteria are met.<\/p>\n

These criteria include, among others: “setting wages,” “supervising the quality and performance of work,” and “setting conditions for access to services.” The Labour and Mining Inspectorate (ITM) can initiate administrative proceedings if it determines that at least three criteria have been met. This means that there is no need to refer the case to labor courts. The draft law also establishes a system of joint and several liability in cases where Platforms cooperate with Fleet Partners. However, if the ITM determines that the criteria are not met, any case regarding reclassification will have to be brought before the labor court.<\/p>\n
