A week ago, we described how Platforms transferred legal liability for selling alcohol to minors or drunks to Suppliers. And that Platforms will become a popular method to circumvent the night ban on selling alcohol in shops in Warsaw (see here<\/a>).<\/p>\n

We asked Janek \u015apiewak, among others, for a comment on this situation (see here<\/a>).<\/p>\n

After publication, we received the statement of the Warsaw City Hall.<\/p>\n

Based on the Act of October 26, 1982 on sobriety education and counteracting alcoholism, the Municipal Council may establish, for the entire municipality or indicated auxiliary units, a limit on the night-time sale of alcoholic beverages intended for consumption outside the place of sale (shops). The limit may apply to sales conducted between 10 p.m. and 6 a.m. and may not go beyond the regulations specified in the Act.<\/p>\n

Referring to the sale of alcoholic beverages via Internet Platforms, with delivery to the customer, it should be noted that in accordance with the above Act, the condition for conducting the sale of alcoholic beverages is the performance of business activity within the scope of the permit only by the entrepreneur indicated therein and only in the place specified in the permit. Alcohol may be issued only in a store whose owner has a permit to sell alcoholic beverages. The transfer of ownership of the item occurs at the moment of transfer of possession of the item, i.e. its delivery to the buyer. Therefore, delivery (e.g. by courier) of an alcoholic beverage to the place indicated by the customer (regardless of the form of payment, method of placing the order, or place of issue of the sales confirmation) is the sale of alcoholic beverages outside the point indicated in the permit. This is the basis for withdrawing the permit.<\/p>\n

The Ministry of Health is of the opinion that enabling the sale of alcoholic beverages via the Internet would increase the availability and expansion of sales channels for alcoholic beverages, which from the point of view of public health should be assessed negatively. According to the Ministry, the current regulations do not allow this form of alcohol distribution. \r\n\r\nNa podstawie ustawy z dnia 26 pa\u017adziernika 1982 r. o wychowaniu w trze\u017awo\u015bci przeciwdzia\u0142aniu alkoholizmowi, Rada gminy mo\u017ce ustali\u0107, dla ca\u0142ej gminy lub wskazanych jednostek pomocniczych, ograniczenie w godzinach nocnej sprzeda\u017cy napoj\u00f3w alkoholowych przeznaczonych do spo\u017cycia poza miejscem sprzeda\u017cy (sklepy). Ograniczenie mo\u017ce dotyczy\u0107 sprzeda\u017cy prowadzonej mi\u0119dzy godzin\u0105 22.00 a 6.00 i nie mo\u017ce wykracza\u0107 poza uregulowania wskazane w ustawie.\r\n\r\nOdnosz\u0105c si\u0119 do sprzeda\u017cy napoj\u00f3w alkoholowych za po\u015brednictwem Platform Internetowych, z dostaw\u0105 do klienta, wskaza\u0107 nale\u017cy, \u017ce zgodnie z powy\u017csz\u0105 ustaw\u0105, warunkiem prowadzenia sprzeda\u017cy napoj\u00f3w alkoholowych jest wykonywanie dzia\u0142alno\u015bci gospodarczej w zakresie obj\u0119tym zezwoleniem tylko przez przedsi\u0119biorc\u0119 w nim oznaczonego i wy\u0142\u0105cznie w miejscu wymienionym w zezwoleniu. Wydanie alkoholu mo\u017ce odbywa\u0107 si\u0119 wy\u0142\u0105cznie w sklepie, kt\u00f3rego w\u0142a\u015bciciel ma zezwolenie na sprzeda\u017c napoj\u00f3w alkoholowych. Przeniesienie w\u0142asno\u015bci rzeczy nast\u0119puje z chwil\u0105 przeniesienia posiadania rzeczy, czyli jej wydania nabywcy. Zatem dostarczenie (np. przez kuriera) napoju alkoholowego do miejsca wskazanego przez klienta (niezale\u017cnie od formy p\u0142atno\u015bci, sposobu dokonania zam\u00f3wienia, czy miejsca wystawienia potwierdzenia sprzeda\u017cy), to sprzeda\u017c napoj\u00f3w alkoholowych poza punktem wskazanym w zezwoleniu. Jest to podstaw\u0105 do cofni\u0119cia zezwolenia.\r\n\r\nMinisterstwo Zdrowia stoi na stanowisku, \u017ce umo\u017cliwienie sprzeda\u017cy napoj\u00f3w alkoholowych przez Internet stanowi\u0142oby zwi\u0119kszenie dost\u0119pno\u015bci i rozszerzenie kana\u0142\u00f3w sprzeda\u017cy napoj\u00f3w alkoholowych, co z punktu widzenia zdrowia publicznego, nale\u017cy oceni\u0107 negatywnie. Zdaniem Ministerstwa obecne przepisy nie umo\u017cliwiaj\u0105 takiej formy dystrybucji alkoholu.
